Ordinarily, people select a close family member or friend they trust implicitly. Conversely, some individuals opt for a professional trustee, especially if their estate is complex or they lack suitable candidates among their personal circle.
It’s important to have open and honest conversations with the person you intend to appoint, explaining your expectations and ensuring they are willing and able to fulfill the role. Remember, this individual will be making significant decisions on behalf of your estate, so selecting them carefully is paramount.
Consequently, I often recommend discussing their willingness and availability openly, as life circumstances can change.
Brenda Davis: Have there ever been any challenges with choosing an Executor or Trustee that you’ve encountered in your practice?
I recall a situation where a client initially named their eldest child as executor. Unfortunately, the child was going through a difficult divorce and wasn’t emotionally prepared for the responsibility. We had to work together to find an alternative solution, which ultimately involved appointing a trusted family friend.
This experience highlighted the importance of considering not just who you trust but also their current life circumstances and capacity to handle the demands of the role.
