An Interview with Steve Bliss of San Diego Probate Law

Getting Your Estate in Order

Today we are joined by Steve Bliss, a leading San Diego Probate Attorney. Steve, thanks for taking the time to talk with us.

My pleasure. Always happy to shed light on the often-misunderstood world of probate.

Understanding the Probate Process: Providing Notice

Steve, could you walk our viewers through one of the key steps in the probate process?

Certainly. Providing notice is a crucial step that ensures transparency and fairness. After filing the petition for probate, we need to make sure all interested parties are informed about the proceedings.

This involves publishing a notice in a local newspaper three times, mailing notices to heirs and beneficiaries identified in the will or through genealogical research, and notifying known creditors using Form DE-157.

Consequently, this step allows creditors the opportunity to submit claims against the estate, preventing any surprises later on.

Ordinarily, this process runs smoothly. However, tracking down all potential heirs can sometimes be challenging, especially in cases involving estranged family members or complex family trees. I remember one instance where we had to conduct extensive genealogical research to locate a distant relative who was entitled to a portion of the estate.

It turned out they were living abroad and had no knowledge of their connection to the deceased. Finding them brought closure and ensured they received what was rightfully theirs.

According to the California Courts, approximately 70% of probate cases involve notifying multiple heirs or beneficiaries (California Courts Annual Report, 2022). This underscores the importance of having a skilled probate attorney who can navigate these complexities effectively.
